CONSTITUTION OF THE LAWYERS FOR HUMAN RIGHTS
INTERNATIONAL
Aims and Objectives :
- To promote human rights education among Lawyer community
and general public and strive for upholding rule of law in the
society.
- To organise, hold workshops, seminars, get-together, functions
and campaigns for promoting, encouraging and protecting the
human rights among the lawyer community.
- To participate in or call any foreign social, educational
functions, seminars festivals in order to promote human rights
of the citizens of the country and for matter connected therewith
or incidental thereto;
- To represent before the appropriate authority on behalf of
the Lawyer community which directly or indirectly affect the
human rights situation in the society;
- To make representations, recommendations, to any governmental,
non-governmental organisaton or authority for seeking grants,
special privileges, donations, sponsorships, funds and immovable
properties and advertisements for the promotion of activities
incidental to the human rights situation and encouragement among
lawyers for social work and human rights activities.
- To strive for welfare of members of the society, wherever
necessity requires so. It would also be the aim of the society
to build relationship of brotherhood, cooperation and granting
affiliation to different social groups and to generate awareness
about the problems and privileges to the lawyers.
- To spread message of one humanity among different sections
of the society and promote awareness about the importance and
benefit of human rights education.
- To undertake and promote research in the field of human rights,
and other areas of social work.
- To undertake social welfare schemes for the benefit of the
citizens, organising medical camps and help suffering people
in case of any natural or man-created disaster, calamity, accident
and to promote brotherhood among the people by organising social
and cultural functions.
- To develop civic consciousness, to raise the standard of living
of the citizens.
- To do all other objects and purposes which may be conducive
to and beneficial for the society and to the human beings.
- To work with full effort to prevent discrimination among
the people on the basis of religion, sex, caste, and creed and
to stop discrimination by legal means.
CONDITIONS OF WORKING:-
- The income and property of the society shall be applied solely
towards the promotion of the objects of the society as set forth
in the Memorandum of Association and no portion thereof shall
be paid or transferred to the members of the society directly
or indirectly.
- No member of the governing body of the society shall be appointed
to any salaried office of the society, or any office of the
society paid by fees, and no renumeration shall be given by
the society to any member of such governing body except repayment
out of pocket expenses and interest on money lent for premises/demises
to the society.
- The society by its constitution will apply its profits, if
any or any other income in promoting its objects;
- If upon winding up or dis-solution of the society, there
remains after liquidation of all its debts and liabilities any
property whatsoever, the same shall not be paid to or distributed
among the members of the society, but shall be given or transferred
to some other organisation having its objects similar to the
objects of the society at or before the time of dis-solution.
DECLARATION:-
We the several persons whose names and addresses are subscribed
hereunder are desirous of being formed a social, voluntary, non-governmental,
non-profit making non-political society in pursuance of this memorandum
of Association.

RULES AND REGULATIONS OF “LAWYERS FOR HUMAN RIGHTS INTERNATIONAL
INTRODUCTION:-
These rules and regulations of Lawyers For Human Rights International
have been framed with a view to run the functioning of the society
and shall be strictly adhered to by all the members throughout
their period of membership. The rules and regulations shall not
be changed, altered or amended without the consent of the General
Body of the society.
MEMBERSHIP:-
All the like minded lawyers who are inclined to dedicate themselves
to the cause of promoting and protecting human rights and agree
to abide by the aims and objects and the rules and regulations
hereinafter framed of the society are eligible to become the members
of the society. The governing body may restrict the membership
of the society without any notice. Any member whether male or
female who is desirous of becoming a member of the society will
apply to the President of the Society in the prescribed form.
REGISTER OF MEMBERS:-
The society shall maintain at its registered office a register
of its members along with their complete bio-data and shall enter
therein, fifteen days thereafter, the particulars of the member.
CATEGORIES OF MEMBERS:-
There would be only one category of members called “Member”.
MEETING:-
The governing body/District Level Unit/Tehsil level units of
the society shall hold meetings at least once in a month in order
to achieve the objectives of the society.
GOVERNING BODY:-
The governing body of the society shall consist of One President,
One Senior Vice-President, One Lady Vice-President, One General
Secretary, three organising Secretaries, One Office Secretary,
One Press Secretary and One Cashier and the total number of members
of the Governing body shall be ten.
QUORUM:-
The quorum of the meeting shall be two third of the total number
of members of the society.
POWERS OF THE GOVERNING BODY:-
President:-
He shall preside over all the meetings of the governing body
and the General body. He shall be the ultimate head of the society.
The decision of the President in the meeting of the Governing
body and the General Body shall be final and binding on all questions
reaised but shall not override the decision of the General Body.
He shall have the authority and power to do the following things
namely:-
- Liasion with various authorities to enforce the aims and objects
of the society;
- Supervise the accounts and activities of the society
- Participate where necessary in any proceeding whether in
a court or before any authority against the violation of human
rights of the people
- Organise functions, seminars, meetings educational workshops
and other means of promoting human rights in India or abroad.
- Every work which has been entrusted to him by the governing
body or the general body of the society.
Senior Vice-President:-
He shall act as President of the society in the absence of the President.
In addition to this, he shall do all other works assigned to him
by the President or the Governing Body from time to time.
Lady Vice-President:-
She shall assist the President or the Senior-Vice-President in performance
of duties. In addition to this, she shall do all other works assigned
to her by the President or the Governing Body from time to time.
General Secretary:-
He shall be the incharge of the office of the Society and shall
act as an adjutant of the society. He is the first man to know everything
about the activities and functions of the society and amongst other
things to do the following acts, deeds and things, namely:-
- To check and verify accounts in the cash book and carry out
periodical inspection of the same;
- To sign and issue notices for calling meetings of the governing
body or general body and to issue Press-releases on behalf of
the society;
- To look after and conduct all correspondence relating to
or in any way concerning the society, record and put it before
the authority concerned;
- To appoint committees for smooth organising of any function,
meets, workshops, etc.
- To call and conduct the meetings of the Governing body and
the General body of the society;
- To keep or cause or cause to be kept in proper order and
custody all documents and all papers and files belonging to
the society;
- To take disciplinary action against any member held guilty
of violating the terms and conditions and rules and regulations
of the society;
Organising Secretary:-
To ensure smooth holding of meetings of District Level/Tehsil Level
units and guide, educate and to make the District Level/Tehsil level
units functional.
Treasurer:-
He shall be responsible for the maintenance of the accounts of the
society. He shall prepare the account books, cash and credit ledger
and place it before the General or Governing body for inspection
periodically.
Press Secretary:-
He shall do liasion with media and public on behalf of the society
and shall strive for building effective and cordial relation with
different social and governmental organisations.
TENURE OF THE GOVERNING BODY:-
The first tenure of the first governing body shall be two years.
After a period two years, the new members of the governing body
shall be elected through General Elections by way of consensus
or secret ballot if necessary. The members of the governing body
shall be entitled to contest the elections for as many time they
want. The term of the governing body shall be two years starting
from January to December of the preceding year.
ELECTIONS OF GOVERNING BODY:-
The members of the Governing Body shall be elected from amongst
the members for electing the members of the Governing Body, general
body of the society shall have the right to vote and the Governing
body may restrict the right to vote to only Presidents and General
Secretaries of the District Units/Tehsil Units at any stage.
FORMATION OF THE GENERAL BODY:-
The General Body of the society shall consist of all the members
of the society including that of the Governing Body. Apart from
this, the General Body shall include any invitee or guest appointed
by the Governing Body.
POWERS OF THE GENERAL BODY:-
The General Body of the society shall assist the governing body
in the implementation of the aims and objects of the society.
The members of the General body may guide the Governing Body from
time to time in the matters of initiating any activity on preferential
basis. The general body shall have over-riding effect on the governing
body and can check the governing body if it feels any dis-satisfaction
over the working of the governing body.
MEETING AND QUORUM OF THE GENERAL BODY:-
The General Body of the society shall conduct at least one meeting
in two months. The quorum of the meeting shall be two third members
of the total membership of the General body.
FORMATION OF DISTRICT LEVEL UNITS:-
The District Level unit may elect its own governing body. The
office-bearers of the District Level unit so elected shall hold
office for a period of one year and perform the duties assigned
to them by the Governing body or the General Body a the case may
be. The Office bearers of the District Level Unit shall be made
in consultation and concurrence of the Governing body of the society.
The Governing body of the society may appoint any observer in
the elections of the District Level Unit in order to ensure smooth
conduct or the elections. The Governing body shall have the power
to remove any member of the District Level unit or take disciplinary
action for mis-conduct or breach of the aims and objects or rules
and regulations of the society. But such action shall be taken
only after consulting the President or the General Secretary of
the District Level Unit.
FORMATION OF TEHSIL LEVEL UINTS:-
The Tehsil level unit shall be formed by the members of the Tehsil
unit from amongst themselves. The office-bearers so appointed
shall hold office for a period of one year and shall be bound
to perform the duties assigned to them by the Governing or General
Body as the case may be. The Governing body of the society shall
have the right to remove any member of the Tehsil level unit or
take disciplinary action for mis-conduct or breach of the aims
and objects or rules and regulations of the society. But such
action shall be taken only after consulting the President or the
General Secretary of the Tehsil Level unit. The governing body
of the society may send its observer in the elections of the office-bearers
of the Tehsil level units in order to ensure smooth conduct of
elections.
RETIREMENT/RESIGNATION/DEATH OF THE MEMBER:-
Any member of the General or Governing body can resign from his
post at any time during his tenure. No member of the Governing
body shall retire from his post during the period of his tenure.
In case of the death of a member of the Governing body, the successor
of such member shall be elected by consensus as acting member
for the remaining period of the tenure of the deceased member.
Any member of the General body can resign from his membership
at any time with prior notice to the General secretary of the
society of not less than twenty days.
INDEMNITY:-
Every member of the society shall be indemnified against all
acts, liabilities arising out of the acts and things done by them
in pursuance of the powers and duties entrusted to them by the
society.
CONSEQUENCES OF NON-ATTENDANCE OF MEMBER IN THE MEETING:-
If any member of the society fail to cause presence for more
than three consecutive meetings of the governing body or the General
body or District Level Unit or Tehsil Level Unit, as the case
may be, such absentee member may be removed from the primary membership
of the society. However, serving of a notice of attendance upon
such member shall be mandatory, before such removal.
FINES AND FORFEITURES UPON MEMBERS:-
If any member is found guilty of mis-conduct or misbehavior during
the meetings or found mis-using the name of the society for his
wrongful personal gains, such a member shall be removed from the
membership of the society.
MANNER OF INVESTMENT OF FUNDS, KEEPING OF ACCOUNTS AND FOR
ANNUAL AUDIT OF ACCOUNTS:-
The funds of the society shall be spent only for the attainment
of the aims and objects of the society. Every expenditure shall
be spent after passing a resolution to this effect by two third
majority of the governing body. The accounts of the society shall
be done by a Chartered Accountant, and properly verified and shall
be open to inspection by the members of the society or any authority.
MANNER FOR MAKING, ALTERING AND RESCINDING RULES AND REGULATIONS
OF THE SOCIETY:-
The rules and regulations of the society can be altered or rescinded
or new rules may be added or amended by a resolution to this effect
passed by at least two third majority members of the General body
present in the meeting.
MANNER OF DIS-SOLUTION OF THE SOCIETY:-
The society shall have its separate legal entity and it will
not be dissolved under any circumstances. The resignation, expulsion,
retirement or death of a member of the Governing body or Genreal
body shall not cause the dissolution of the society.
OPERATION OF BANK ACCOUNT:-
The bank account of the society shall be operated upon either
by the President and Secretary or the President and Cashier or
either by the Secretary and the Cashier jointly only.
